Terms and Conditions (T&C)

1. Scope of Application

These Terms and Conditions (T&C) apply to all orders placed by consumers (§ 13 BGB) or business customers (§ 14 BGB) via our online shop [Shop Name].
Any differing terms and conditions of the customer will not be accepted unless we have expressly agreed to them in writing.

2. Contractual Partner

The purchase contract is concluded with:

[Company Name]
[Address]
[Email Address]
[Phone Number]
[Commercial Register, if applicable]

3. Conclusion of Contract

The product presentations in our online shop do not constitute a legally binding offer but rather an invitation to place an order.
By clicking the “Buy Now” button, you submit a binding offer to purchase.

We confirm receipt of your order by email. The contract is only concluded once we confirm the dispatch of the goods.

4. Prices and Shipping Costs

All prices are stated in Euro (€) and include the statutory value-added tax (VAT).
Shipping costs may be added, which will be displayed before completion of your order in the shopping cart.

5. Delivery

Deliveries are made within Germany and – if specified – to other countries.
Unless otherwise stated, the delivery time is 2–5 business days after receipt of payment.

If a product is unavailable, we will inform you immediately and refund any payments already made.

6. Payment

We offer the following payment methods:

  • Bank transfer (prepayment)

  • PayPal

  • Credit card

  • Other payment methods displayed during checkout

The invoice amount is due immediately unless another payment term has been agreed.

7. Right of Withdrawal

Consumers have a statutory right of withdrawal in accordance with §§ 355 et seq. BGB.
Details are explained in our Withdrawal Policy, which you can find [insert link or include text here].

Exceptions:
The right of withdrawal does not apply to sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (§ 312g(2) No. 3 BGB).

8. Retention of Title

The goods remain our property until full payment has been received.

9. Warranty and Liability

Statutory warranty rights apply.
We are fully liable for intent and gross negligence.
In cases of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations) and limited to the foreseeable, typical damage.

10. Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If any provision of these T&C is invalid, the validity of the remaining provisions shall not be affected.
